Terms of Service

These Terms of Service ("Terms") govern your use of the Instelo desktop application, website, and related services (together, the "Service"), operated by Instelo. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) and legally able to enter into a binding contract. You are responsible for all activity that occurs under your account.

2. Your account

You agree to provide accurate registration information and to keep your credentials secure. Notify us promptly at tryinstelo@gmail.com if you suspect unauthorized use of your account. We may suspend accounts that appear compromised to protect you and the Service.

3. Plans, subscriptions, and billing

• Free plan: includes a limited daily usage allowance as described in the app. We may adjust free limits over time.
• Paid plans: billed monthly through Stripe at the prices shown in the app. Subscriptions renew automatically each billing period until canceled.
• Cancellation: you can cancel anytime through the customer portal in the app. Your plan remains active until the end of the current billing period.
• Refunds: handled in accordance with applicable law and Stripe policies unless we state otherwise in writing.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Use the Service to cheat on exams or assessments where doing so violates the rules that apply to you
• Attempt to bypass usage limits, security measures, or access controls
• Reverse engineer, resell, or redistribute the software except as permitted by law
• Interfere with or disrupt the Service or other users
• Use the Service to create content that infringes third-party rights or violates applicable law

You are responsible for ensuring that your use of Instelo — including undetectable mode — complies with the rules, policies, and laws that apply to you, such as workplace policies, academic honor codes, and the terms of other software you use.

5. AI-generated output

Instelo responses are generated by third-party AI models (OpenAI, Anthropic, and Google) and may be inaccurate, incomplete, or outdated. Output is provided for informational purposes only. You are responsible for reviewing output before relying on it — especially for professional, medical, legal, or financial decisions.

6. Screen capture and agentic features

When you send a request, Instelo captures your screen locally and transmits it through our secure backend to your chosen AI provider to generate a response. Agentic features can type into the active field on your instruction; you are responsible for where and how you direct these actions. See our Privacy Policy for details on how this data is handled.

7. Intellectual property

We retain all rights in the Instelo software, branding, and website. You retain rights in the content you submit. You grant us a limited license to process your requests solely to operate and improve the Service.

Our Privacy Policy explains how we handle personal data and is incorporated into these Terms by reference.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR $100 IF YOU USE ONLY THE FREE PLAN.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (including Sections 7, 9, and 10) will survive.

12. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
